Terms of Service
These terms govern access to TekMail, an email infrastructure and control service for software agents.
Effective August 5, 2026
1. Agreement and operator
TekMail is a product of Lavigne Holdings LLC ("TekMail," "we," "us"). By creating an account, purchasing a subscription, or using the service, you agree to these Terms and the Acceptable Use Policy. If you use TekMail for an organization, you represent that you can bind that organization.
2. Accounts and agent identities
You are responsible for your account, users, agent identities, API keys, integrations, and all activity performed with them. Keep credentials secure, use a separate configured TekMail agent for each email identity, and promptly revoke credentials that may be compromised.
3. Customer content and instructions
You retain your rights in the email, attachments, policies, configuration, and other content you submit. You grant TekMail the limited rights needed to host, route, scan, store, and deliver that content and to operate, secure, and support the service. You are responsible for having the rights and lawful basis needed to process your content and contact recipients.
Risk scores and automated protections are aids, not guarantees. You remain responsible for reviewing high-impact actions and for the behavior of your agents and connected systems.
4. Plans, limits, and billing
- Paid subscriptions renew each billing period until canceled.
- Usage limits include inbound and outbound billable messages as displayed for the plan.
- When a limit is reached, TekMail may pause or reject additional processing rather than charge an unlisted overage.
- Organization plans may be priced by paid user or seat as shown at checkout.
- Taxes may be added where required. Stripe processes payment details on our behalf.
Cancellation and refund terms are described in the Cancellation & Refund Policy. A separate order form controls if it conflicts with these online terms.
5. Service operation
We may change, suspend, or discontinue features; enforce reasonable technical limits; and take action needed to protect the service, recipients, or third-party providers. We aim to provide advance notice of material changes when practical. Beta, preview, demo, and documentation-only features may be changed or removed.
6. Suspension and termination
You may stop using TekMail at any time. We may suspend or terminate access for nonpayment, material breach, security risk, unlawful activity, provider or recipient harm, or conduct prohibited by the Acceptable Use Policy. We may preserve or disclose records when reasonably necessary to comply with law, enforce these terms, or investigate abuse.
7. Disclaimers and liability
TekMail is provided on an "as is" and "as available" basis to the extent permitted by law. We do not promise uninterrupted delivery, perfect threat detection, or that every message will be accepted by a provider or recipient. To the maximum extent permitted by law, Lavigne Holdings LLC is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or lost data. Our aggregate liability for the service will not exceed the amount you paid for TekMail during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law.
8. Changes and contact
We may update these terms by posting a revised effective date. Material changes will be communicated through the service or other reasonable means. Continued use after the effective date constitutes acceptance where allowed by law.
